LeadWin has five legal texts. This article tells you which text covers what and where to find it. The wording on each page is always what counts. This overview is not legal advice.

- The Terms of Use apply to everyone who uses the LeadWin dashboard, including the free plan and the trial.
- The Terms and Conditions apply in addition as soon as you book a paid plan.
- The Data Processing Agreement (DPA) covers the data of your website visitors that LeadWin processes on your behalf.

Where to find the texts
The footer of every page links four of them, the footer in the dashboard included: legal notice, privacy, terms and conditions and terms of use. You find the DPA in the dashboard under Setup → Privacy. All five texts exist in German, English, French and Dutch. The numbering of the sections is the same in every language.
Terms of Use
The Terms of Use govern the use of the platform: your account, access for your team members, permitted use, your content and the suspension of an account. They apply to account holders, to invited team members and to the free plan and the trial. Using the platform itself is free of charge.

Terms and Conditions
The Terms and Conditions govern the contract for a paid plan you book on leadwin.ai: conclusion of the contract, term and cancellation, prices, allowance and payment, liability and changes. Where they contradict the Terms of Use, the Terms and Conditions prevail.

Data Processing Agreement (DPA)
On your website you are the controller of your visitors' data. LeadWin processes it only on your behalf, under Art. 28 GDPR. The DPA sets out what applies: which data, for how long, which sub-processors and how data is deleted. It applies for as long as you have a LeadWin account, including on the free plan.
You conclude the DPA once for your whole account. If you registered your account on leadwin.ai, that happened with the registration. If you come from Feedbax, you accept it in the dashboard. Without the DPA there is no code for your website.

Privacy Policy
The Privacy Policy applies to visitors of leadwin.ai and to you and your team in the dashboard. For your own website visitors, your privacy policy is what counts. Section 8 of the LeadWin Privacy Policy describes what the agent processes technically on your website. A ready-made paragraph for your own privacy policy is under Privacy.

The legal notice names the provider of LeadWin with address, contact and VAT ID. LeadWin is a product of Feedbax.

Frequently asked questions
Which texts apply if I use the free plan?
The Terms of Use, the DPA and the Privacy Policy. The Terms and Conditions only apply once you book a paid plan (Terms and Conditions sections 2.4 and 5). A trial does not turn into a paid plan by itself.
How do I cancel my plan?
Through the customer portal, which you open from the dashboard, or by email to [email protected]. Section 6 of the Terms and Conditions covers this. How it works in the dashboard is in Manage your plan.
What happens to my data when the plan ends?
Your account, conversations, contacts and settings are kept. Data is only deleted when you delete an agent or your account or ask for deletion. Terms and Conditions section 6.7 and DPA section 10 cover this. How to delete your account is in Account.
Do I need a signed DPA?
No. The DPA comes into effect with your consent, no signature is needed. If you still need a signed copy, write to [email protected].
Which sub-processors does LeadWin use?
The list is in Annex 2 of the DPA, with location, purpose and the basis of any transfer. LeadWin informs you of a change by email at least 30 days in advance (DPA section 6).
Does LeadWin use my conversations to train AI models?
No. This is in section 9.3 of the Terms and Conditions.
Can LeadWin change the terms or the prices?
Yes, with notice at least six weeks in advance. You can then cancel. Terms and Conditions section 7.6 covers prices and section 16 the terms themselves.
I came to LeadWin through Feedbax. What applies to me?
For using the dashboard, the LeadWin Terms of Use apply and, in addition, the Feedbax terms of use (Terms of Use section 2.1). You accept the DPA in the dashboard. What your Feedbax plan includes is in LeadWin in your Feedbax plan.
